2. VEHICLE AND RENTAL INFORMATION

The vehicle and rental information are recorded in the Vehicle Delivery Form on the first page and in THELEON's electronic rental system.

Any existing scratches, dents, breakage, damage, and interior/exterior condition of the vehicle at the time of delivery, as well as the condition of the documents, accessories and equipment delivered with the vehicle, may be recorded by THELEON via photograph and/or video.

The RENTER cannot be held responsible for damage or deficiencies that are determined, by photographs, videos or delivery records, to have existed at the time of delivery.

3. SUBJECT OF THE AGREEMENT

The subject of this agreement is to place the vehicle, over which the LESSOR holds the right of use, at the disposal of the RENTER for a specified period, and to determine the terms of use, delivery, return, pricing, damage, insurance, coverage and other rental conditions of the vehicle.

By taking delivery of the vehicle, the RENTER acknowledges that this agreement, the rental information, the vehicle delivery records, and the terms of the additional services and coverage options they have chosen have been presented to them.

4. DELIVERY OF THE VEHICLE AND RECORDING OF DELIVERY CONDITION

The LESSOR shall deliver the vehicle to the RENTER in working condition, suitable for normal use.

When taking delivery of the vehicle, the RENTER is obliged to check the following elements of the vehicle:

  • exterior body
  • interior
  • fuel level
  • mileage
  • tires
  • windows
  • headlights
  • overall visible condition

The delivery condition of the vehicle may be recorded by THELEON via photograph and/or video.

The RENTER must notify THELEON, before starting to use the vehicle, of any obvious damage or deficiencies noticed at delivery that were not recorded.

5. USE OF THE VEHICLE

The RENTER must use the vehicle carefully, in accordance with the manufacturer's usage conditions and the traffic legislation in force.

The RENTER is obliged to take reasonable measures to ensure the vehicle is used safely, to take into account any serious malfunction or warnings appearing on the vehicle's indicators, and to prevent damage to the vehicle.

6. PROHIBITED USES

The vehicle may not be used in the following ways:

  • While under the influence of alcohol
  • Under the influence of narcotic or stimulant substances
  • Under the influence of substances that significantly affect the driver's reflexes or driving ability
  • Without a valid driver's license
  • In violation of the usage restrictions on the driver's license
  • By a driver not registered in the agreement
  • In races, rallies or speed trials
  • In motorsports
  • For driver training purposes
  • For commercial passenger transportation
  • For unauthorized commercial freight transportation
  • In activities constituting a crime
  • For transporting smuggled or prohibited goods
  • In excess of the passenger or load capacity specified in the vehicle's registration
  • To tow or push another vehicle without permission
  • On terrain, sand, mountainous areas, riverbeds, swamps, beaches or similar areas not suitable for the vehicle's technical structure
  • In areas closed to traffic
  • In a manner that would damage the mechanical and technical structure of the vehicle

Damages arising from the RENTER's violation of these prohibitions that are not covered by insurance or coverage may be charged to the RENTER in proportion to their fault and legal liability.

7. DRIVER, ADDITIONAL DRIVER, USE BY THIRD PARTIES AND SUBLEASING

The vehicle may only be used by the RENTER and by drivers named in this agreement or in the rental records who meet the required age and driver's license conditions.

For an additional driver to be able to use the vehicle, they must be registered in the system before the start of the rental or, with THELEON's approval, during the rental period.

The RENTER may not allow third parties not registered in the agreement to use the vehicle.

The RENTER may not dispose of the vehicle in the following ways:

  • rent it to another person
  • sublease it
  • use it as collateral
  • pledge it
  • establish any right in favor of third parties

Incidents occurring when the vehicle is used by a person not registered in the agreement shall be evaluated within the framework of the relevant insurance and coverage terms and the fault status.

Damages arising from use by an unregistered driver that are not covered by insurance or coverage may be charged to the RENTER to the extent of their fault and legal liability.

8. AGE, DRIVER'S LICENSE, YOUNG DRIVER AND DRIVER'S LICENSE RESTRICTIONS

8.1. General Age and Driver's License Requirements

The following conditions generally apply for THELEON vehicles to be rented:

Minimum driver age: 24
Minimum driver's license validity period: 2 years

The RENTER and registered additional drivers must hold a valid driver's license suitable for driving the rented vehicle class.

The vehicle may not be used in the following cases:

  • The driver's license has expired
  • The driver's license has been revoked
  • The driver's license has been temporarily or permanently cancelled
  • The driver's license does not authorize driving of the relevant vehicle class
  • The driver does not have the legal authority to drive

8.2. Young Driver Program

THELEON may offer drivers who do not meet the standard age and/or driver's license validity period requirements the opportunity to rent a vehicle under the Young Driver Package, in suitable vehicle groups.

The minimum age, minimum driver's license validity period, suitable vehicle groups, additional fee, and any additional authorization hold or deposit conditions applicable under the Young Driver Package are notified to the RENTER during the reservation or rental process and shown in the rental record.

The Young Driver Package may not be valid for every vehicle group.

Purchase of the Young Driver Package does not remove the driver's obligation to hold a valid driver's license, the legal restrictions on the driver's license, or the vehicle usage rules contained in this agreement.

Incidents occurring when a young driver uses the vehicle without being specified in the rental record or agreement shall be evaluated within the framework of the relevant insurance and coverage conditions and the fault status.

8.3. Notification of Restriction Codes on the Driver's License

The RENTER and registered additional drivers must act in accordance with any restriction, code, special device or vehicle adaptation requirement specified on their driver's licenses by the competent authorities.

The RENTER and registered additional drivers are obliged to accurately and completely notify THELEON, prior to the rental transaction, of any restrictions on their driver's licenses that affect vehicle use.

In this context, the following conditions and restrictions in particular must be taken into account:

  • being restricted to driving only automatic transmission vehicles
  • the requirement to wear glasses
  • the requirement to wear contact lenses
  • use of a prosthesis
  • the requirement for special equipment or apparatus
  • vehicle usage restrictions related to health condition
  • other legal restriction codes on the driver's license

The RENTER or additional driver may not make incomplete, misleading or untrue statements regarding the restrictions on their driver's license.

8.4. Obligation to Drive a Vehicle Suitable for License Codes

A RENTER or additional driver with a restriction code on their driver's license may only drive vehicles that the relevant codes permit.

It is prohibited to use a vehicle that does not have the features required by the restriction on the driver's license. For example:

  • a driver permitted to drive only automatic transmission vehicles driving a manual transmission vehicle
  • a driver required to wear glasses or lenses driving without fulfilling this requirement
  • a driver requiring special equipment driving a standard vehicle that lacks the required equipment

These circumstances constitute a breach of this agreement. The RENTER may neither drive a vehicle that does not comply with their driver's license conditions themselves, nor allow it to be driven by registered or unregistered third parties.

8.5. Concealment of Restrictions or False Statements

Legal, administrative and financial consequences arising from the RENTER's or additional driver's concealment of restrictions on their driver's license, incomplete notification, misleading or untrue statements, or driving a vehicle not permitted by their driver's license codes, shall be evaluated within the framework of the fault of the relevant person and the applicable legislation.

THELEON's obligations arising from its own fault or from responsibilities legally imposed on it are reserved.

8.6. Effect on Insurance and Coverage Scope

If an accident or damage occurs during use in violation of driver's license restrictions, the incident shall be evaluated within the framework of the applicable legislation, the vehicle's compulsory traffic insurance, comprehensive (kasko) or rent-a-car policy, the coverage products purchased by the RENTER, the manner in which the incident occurred, and the fault status.

If the insurance or coverage is not applied, in whole or in part, due to use in violation of the driver's license restriction, or if the insurance company exercises recourse against THELEON, damages arising from the fault of the RENTER or the relevant driver that are not covered by insurance/coverage may be charged to the responsible person.

This provision does not mean that the insurance or comprehensive (kasko) policy automatically becomes invalid in every case.

8.7. Traffic Fines and Impoundment of the Vehicle

Traffic or administrative fines imposed due to use in violation of driver's license restrictions belong to the driver who committed the violation.

Therefore, towing, impound lot and other direct and documentable expenses arising from the immobilization, towing, traffic ban, or seizure of the vehicle to an official impound lot may be charged to the at-fault driver or the legally responsible RENTER.

Other damages alleged to have arisen due to the period during which the vehicle could not be used shall be evaluated according to the specific circumstances of the case and the applicable legal provisions.

8.8. Responsibility of Additional Drivers

The age, driver's license, young driver, driver's license restriction code, and special vehicle usage conditions set out in this article also apply to all registered additional drivers.

The RENTER is obliged to ensure that additional driver information is correctly reported and that the additional driver meets the required driver's license conditions.

9. MILEAGE USAGE TERMS

The mileage usage limits of rented vehicles are applied according to the rental period as follows:

Rental PeriodMileage Limit
1 - 3 Days350 KM / Day
4 - 7 Days280 KM / Day
8 - 14 Days250 KM / Day
15 - 21 Days200 KM / Day
22 - 25 Days160 KM / Day
26 Days and OverTotal 4,000 KM / Fixed Monthly Limit

The RENTER is obliged to use the vehicle in accordance with the mileage limit determined according to the rental period.

If the mileage limit is exceeded, the excess mileage fee notified to the RENTER at the time of rental or vehicle delivery shall apply to the excess kilometers.

The vehicle mileage records at the time of delivery and return are taken as the basis for the mileage calculation.

Tampering with the odometer or the vehicle's mileage recording system constitutes a material breach of the agreement.

10. FUEL POLICY

The vehicle must be returned with the same fuel level at which it was delivered.

For vehicles returned with insufficient fuel, the cost of the missing fuel shall be calculated based on the current fuel price and may be charged to the RENTER.

If the vehicle is returned with a higher fuel level than it was delivered with, no refund shall be made for the excess fuel.

Towing, fuel drainage, service, parts, labor and mechanical damage costs arising from the use of incorrect or unsuitable fuel may be charged to the at-fault RENTER.

11. RENTAL FEE AND PAYMENT

Unless otherwise agreed, the rental fee is collected in advance.

The RENTER is obliged to pay the following fees arising from the rental:

  • rental fee
  • additional service fees
  • excess mileage fees
  • missing fuel fee
  • HGS (electronic toll) and paid road tolls
  • parking fees
  • traffic and administrative fines
  • one-way fees
  • damages and losses for which the RENTER is responsible
  • fees arising from the extension of the rental period
  • other due and documentable debts arising under the agreement

12. DEPOSIT AND CREDIT CARD AUTHORIZATION HOLD

THELEON may take a deposit or authorization hold from a credit card depending on the rented vehicle group and rental conditions.

The deposit or authorization hold serves as security for the rental fee, damage, fuel, excess mileage, HGS and toll charges, traffic fines, parking, deficiencies occurring in the vehicle, and other due and documentable debts arising from the agreement.

The amount of the authorization hold or deposit does not represent the upper limit of the RENTER's liability.

If the vehicle is returned in accordance with the agreement and no outstanding debt is identified, THELEON shall release the authorization hold or refund the deposit.

THELEON is not responsible for the time it takes banks to reflect the release of the authorization hold on the RENTER's available credit card limit.

13. COLLECTION OF SUBSEQUENTLY ARISING DEBTS

HGS, highway, bridge, tunnel, parking, traffic or administrative fines that reach THELEON after the vehicle is returned, other official fees related to the rental period, and documentable debts arising from an inspection carried out after delivery may be notified to the RENTER and collected lawfully through a valid payment method or the existing security/authorization hold.

14. HGS, HIGHWAY, BRIDGE AND TUNNEL FEES

The RENTER is responsible for toll roads, HGS, highway, bridge and tunnel crossings made during the rental period.

Notification of these fees to THELEON after the rental has ended does not remove the RENTER's payment obligation.

15. TRAFFIC AND ADMINISTRATIVE FINES

Traffic or administrative fines arising from the use of the vehicle during the rental period belong to the driver who committed the relevant act.

If the fine or administrative sanction reaches THELEON after the vehicle is returned, amounts that can be associated with the rental period may be notified to the RENTER.

The RENTER's legal rights to object to and appeal the relevant administrative action are reserved.

16. PARKING AND VALET

The fees for paid parking used by the RENTER for the vehicle belong to the RENTER.

Incidents and damages arising when the RENTER hands over the vehicle to a third-party valet service shall be evaluated according to the specific circumstances of the case, fault, and the scope of insurance/coverage.

17. ABSOLUTE PROHIBITION ON TAKING THE VEHICLE ABROAD

It is absolutely prohibited to take the rented vehicle outside the borders of the Republic of Turkey.

THELEON does not grant permission for its rental vehicles to be used abroad under any circumstances.

The RENTER may not take the vehicle outside the borders of the Republic of Turkey via land border crossing, sea port, ferry, Ro-Ro, or any other method, nor may they allow it to be taken out by third parties.

Violation of this prohibition constitutes a material breach of the agreement.

Towing, transportation, storage, customs, official procedure, vehicle repatriation to Turkey, and direct damage costs arising from taking the vehicle abroad that are not covered by insurance/coverage may be charged to the at-fault RENTER.

18. MAINTENANCE AND BREAKDOWN

The RENTER must monitor the warnings on the vehicle's dashboard.

If a warning appears related to engine temperature, oil pressure, the brake system, or any warning that could cause serious damage if the vehicle continues to be used, the RENTER must safely stop the vehicle and notify THELEON.

The RENTER may not have repairs, part replacements, accessory changes, mechanical intervention, electronic intervention, or modifications made to the vehicle without THELEON's approval.

The RENTER is not responsible for ordinary mechanical failures not caused by the RENTER's fault.

19. ROADSIDE ASSISTANCE AND TOWING

If an accident or breakdown occurs with the vehicle, the RENTER must first contact THELEON.

THELEON's current roadside assistance numbers are: 0532 399 19 21 and 0533 334 71 20.

In the event of ordinary technical failures not caused by the RENTER's fault, roadside assistance or towing is organized by THELEON.

Roadside assistance or towing costs arising in the following situations may be charged to the RENTER:

  • wrong fuel
  • key loss
  • leaving the key inside the vehicle
  • battery drain due to the RENTER's negligence
  • driving the vehicle onto unsuitable terrain
  • tire/rim damage caused by the RENTER's fault
  • use in violation of the agreement

20. WHAT TO DO IN THE EVENT OF AN ACCIDENT OR DAMAGE

In the event of an accident or damage, the RENTER must immediately notify THELEON.

Depending on the nature of the incident, the RENTER must carry out the following actions:

  • Ensure life and traffic safety
  • Notify the police or gendarmerie when necessary
  • Ensure that an accident report or official incident report is prepared in accordance with the legislation
  • Take photographs of the scene of the incident
  • Photograph the damaged areas of the vehicles
  • Obtain the information of the other vehicle and driver
  • Obtain the registration and traffic insurance information of the other vehicle
  • Obtain an alcohol test report when necessary
  • Provide the documents requested by THELEON or the insurance company

The necessary accident documents must be delivered to THELEON as soon as possible and, as a rule, within 24 hours from the date of the incident.

In accidents involving injury, death, damage to public property, or where the law requires law enforcement to be called, it is mandatory to notify the police or gendarmerie.

Leaving the Scene of the Accident and Avoiding Testing: If the RENTER or the registered driver operating the vehicle leaves the scene of the accident without a justified and compelling reason in cases where the law requires them to remain, fails to notify law enforcement when required, obstructs the determination of the incident, or avoids undergoing an alcohol and/or narcotic/stimulant substance detection test requested by the competent authorities, this constitutes a material breach of the agreement. If, as a result of such conduct, the insurance or coverage is not applied in whole or in part, or the insurance company exercises recourse against the LESSOR, vehicle damage, third-party losses and other direct losses arising from the fault of the RENTER or the relevant driver that are not covered by insurance/coverage may be recovered from the responsible person.

21. INSURANCE AND COVERAGE

Rented vehicles are covered by Compulsory Motor Third-Party Liability Insurance in accordance with the applicable legislation.

THELEON may also offer various coverage products. These may include the following:

  • Third-Party Coverage
  • Tire, Glass and Headlight Coverage
  • Personal Accident Coverage
  • Mini Damage Coverage
  • Mega Mini Damage Coverage
  • Super Mini Damage Coverage
  • Deductible-Free Accident Coverage
  • Express Package
  • Gold Package
  • Platinum Package
  • Other coverage packages offered by THELEON

The coverage or package purchased by the RENTER is separately indicated in the rental record.

The scope, limits, deductibles and exclusions of coverage products are applied according to the product terms in effect at the time of purchase and the relevant insurance policies.

22. MINI DAMAGE AND DAMAGE LIABILITY

If Mini Damage Coverage or a similar coverage product is not purchased by the RENTER, the repair, parts and labor costs of damages for which the RENTER is responsible, including minor damages occurring during the rental period, may be charged to the RENTER.

If Mini Damage or another coverage product is purchased, the coverage applies only within the limits and scope of the relevant product.

If the accident or damage occurs due to the RENTER's fault, the extent to which the vehicle's damage will be covered is determined according to the existing comprehensive (kasko) policy, coverage terms, the manner in which the incident occurred, and exclusions.

23. SITUATIONS THAT MAY FALL OUTSIDE INSURANCE AND COVERAGE SCOPE

Subject to the relevant insurance policy and coverage terms, the following situations in particular may affect the scope of coverage or fall outside it:

  • Driving under the influence of alcohol
  • Driving under the influence of narcotic or stimulant substances
  • Driving without a valid driver's license
  • Use in violation of driver's license restrictions
  • The vehicle being driven by a driver not registered in the agreement
  • Use of the vehicle in a race or speed trial
  • Use of the vehicle for a purpose contrary to the agreement
  • Intentional damage
  • Failure to obtain the necessary accident documents without justified reason
  • Leaving the scene of the accident without justified reason, failing to make the required notifications to law enforcement, or avoiding an alcohol/narcotics detection test
  • Use of incorrect fuel
  • Use of the vehicle on unsuitable terrain, beaches, in water or similar areas
  • Failure to observe the vehicle's height limit
  • Other situations explicitly excluded in the insurance policy or coverage terms

The RENTER's liability is determined according to the manner in which the incident occurred, the fault status, and the relevant policy and coverage terms.

24. TIRE, GLASS, HEADLIGHT AND RIM DAMAGE

Whether tire, glass, headlight and rim damage is covered depends on the terms of the purchased coverage package.

Damage resulting from curb impact, use on unsuitable surfaces, continuing to drive on the rim, or driving error is evaluated separately.

25. UNDERCARRIAGE AND ROOF DAMAGE

The RENTER is obliged to take into account the vehicle's ground clearance and overall height.

Damage occurring to the underside or top of the vehicle due to parking garage entrances, barriers, balconies, branches, bridges, ceilings, curbs or road conditions is evaluated according to the manner in which the incident occurred and the scope of coverage.

26. THEFT

In the event of theft of the vehicle or its parts, the RENTER must immediately notify law enforcement and THELEON.

The RENTER is obliged to obtain the necessary official reports and, if possible, deliver the vehicle keys and vehicle documents to THELEON.

The application of theft coverage is subject to the relevant policy and coverage terms.

27. KEY, REGISTRATION, LICENSE PLATE AND ITEMS PROVIDED WITH THE VEHICLE

The RENTER is obliged to safeguard the vehicle key, registration document, license plate, and other items and accessories delivered to them with the vehicle.

The condition of the delivered items is, when necessary, determined based on the photographs and/or video recordings taken during vehicle delivery.

The actual replacement, coding, document reissuance, towing and similar direct costs of keys, registration documents, license plates or other items lost or damaged due to the RENTER's fault may be charged to the RENTER.

28. SMOKING, CLEANING AND ANIMAL TRANSPORT

Documentable cleaning or repair costs arising from burns, persistent odor, upholstery damage or the need for special cleaning caused by smoking or the use of similar tobacco products inside the vehicle may be charged to the RENTER.

The use of vehicles for transporting animals is prohibited.

Ordinary soiling resulting from normal use is not separately charged.

In cases of vomit, biological contamination, excessive mud, sand, permanent stains or situations exceeding ordinary cleaning, the actual and documentable special cleaning cost may be charged to the RENTER.

29. INFANT / CHILD SEAT

Vehicles may not come with an infant or child seat as standard.

At the RENTER's request, a child seat may be provided as an additional service, subject to availability and the applicable rate.

30. GPS, VEHICLE TRACKING AND TELEMATICS SYSTEMS

Vehicles may be equipped with GPS and telematics systems for the purposes of theft prevention, vehicle security, determining the vehicle's location, fleet management, mileage tracking and operations management.

Personal data obtained from these systems is processed in accordance with the applicable personal data protection legislation and THELEON's Data Protection (KVKK) Disclosure Notice.

31. RETURN OF THE VEHICLE

The RENTER is obliged to return the vehicle to THELEON at the date and time specified in the agreement, at the designated return point, with the fuel level at which it was received, and without new damage beyond normal use.

When the vehicle is returned, THELEON checks the mileage, fuel, the interior and exterior condition of the vehicle, and any visible damage.

The return condition may be recorded via photograph and/or video.

The RENTER's absence during the return inspection does not prevent them from being notified of damage that is objectively identified afterward and can be associated with the rental period.

32. RETURN TO A DIFFERENT LOCATION AND ONE-WAY RENTAL

The vehicle may not be left at a location other than the agreed return point without THELEON's approval.

If the vehicle is returned to a different city or location with THELEON's approval, the one-way fee or vehicle transport fee notified at the time of reservation or rental shall apply.

If the vehicle is left at another location without permission, the reasonable and documentable costs incurred to bring the vehicle to the delivery point may be charged to the RENTER.

33. LATE RETURN

The RENTER must return the vehicle on the date and at the time specified in the agreement.

The following fees may apply in accordance with THELEON's current late return tariff:

  • For a delay of 1 hour or more: 1/3 of the daily rental fee
  • For a delay of 2 hours or more: 2/3 of the daily rental fee
  • For a delay of 3 hours or more: one full day's rental fee

Delays exceeding 24 hours are separately evaluated according to the current rental tariff and the circumstances of the case.

If the RENTER wishes to extend the rental period, they must obtain approval from THELEON before the current rental period ends.

Continuing to use the vehicle without THELEON's approval does not mean that the rental agreement is automatically extended.

34. EARLY RETURN - NO REFUND

If the RENTER voluntarily returns the vehicle before the end of the rental period specified in the agreement, no refund shall be made for unused days or periods.

In cases of early return caused by the RENTER, such as a change in travel plans, no longer needing the vehicle, personal reasons, or voluntarily terminating the rental early, no refund shall be made based on the rental fee originally agreed upon.

If the vehicle cannot be provided or the service cannot be performed due to a reason attributable to THELEON and not attributable to the RENTER, the RENTER's rights arising from the applicable legislation are reserved.

35. FAILURE TO COLLECT THE VEHICLE ON TIME / NO-SHOW

If the vehicle is not collected at the agreed time despite the reservation or rental fee having been paid in advance, THELEON's current reservation and no-show conditions shall apply.

If the vehicle is not collected on time, THELEON has no obligation to hold the vehicle for the RENTER for the entire reservation period.

A subsequent request by the RENTER to collect the vehicle shall be evaluated based on vehicle availability at that time.

36. REPLACEMENT VEHICLE

If the vehicle becomes unusable due to a technical failure not caused by the RENTER's fault, THELEON may provide a replacement vehicle in the same or a similar segment, subject to operational availability.

If the same vehicle group is not available, a different vehicle group may be offered.

Providing a free replacement vehicle is not mandatory in incidents arising from the RENTER's fault or use in violation of the agreement.

37. VEHICLE MAKE/MODEL IN RESERVATION

If a reservation is made based on a vehicle group, a specific make or model is not deemed guaranteed.

A vehicle of the same segment or with similar features may be delivered.

If the vehicle group in the reservation is unavailable for operational reasons, THELEON may, to the extent possible, offer an equivalent or higher segment vehicle.

If a lower segment vehicle is provided, the necessary price adjustment, if any, shall be made.

38. IMPOUNDMENT OF THE VEHICLE BY OFFICIAL AUTHORITIES OR TRAFFIC BAN

Towing, impound lot and other direct and documentable expenses arising from the traffic ban, towing, seizure to an official impound lot, immobilization by official authorities, or confiscation of the vehicle due to the fault or unlawful conduct of the RENTER or the registered driver may be charged to the at-fault RENTER.

Claims for damages arising from the period during which the vehicle could not be used shall be evaluated within the framework of the specific circumstances of the case and the applicable legal provisions.

39. BREACH OF AGREEMENT AND TERMINATION

The following circumstances constitute a material breach of the agreement:

  • Allowing the vehicle to be used by an unauthorized person
  • Use under the influence of alcohol or drugs
  • Use without a driver's license
  • Use in violation of driver's license restrictions
  • Use of the vehicle for criminal purposes
  • Taking the vehicle outside the borders of the Republic of Turkey
  • Subleasing the vehicle
  • Tampering with the mileage system
  • Failure to return the vehicle at the end of the agreement
  • Use that seriously endangers the safety of the vehicle

In these cases, THELEON may terminate the agreement and demand the return of the vehicle through lawful means.

Rental fees, damages and other receivables that have accrued up to the date of termination do not cease to exist due to the termination.

40. FORCE MAJEURE

Natural disasters, war, terrorism, general strikes, epidemics, public authority decisions, obstruction of transportation, or similar events beyond the reasonable control of the parties may be considered force majeure.

In the event of force majeure, the obligations of the parties shall be determined according to the effect of the event and the applicable legal rules.

41. AGREEMENT AND SIGNATURE VIA TABLET

THELEON may prepare vehicle rental agreements and related rental documents in electronic form.

This agreement may be presented for the RENTER's review via a tablet or similar electronic device.

If the RENTER reviews and accepts the agreement, they may sign it in their own handwriting on the tablet screen.

The signature record created via tablet may be retained for the purpose of recording the rental transaction and the RENTER's declaration of acceptance of the agreement in electronic form.

The term "tablet signature" used in this provision does not mean a "secure electronic signature" unless the system used also satisfies the secure electronic signature requirements defined in Law No. 5070 on Electronic Signatures.

If the tablet system also records the dynamic characteristics of the signature such as pressure, speed, acceleration or angle, the processing of this data is carried out in accordance with the applicable personal data protection legislation.

42. PROTECTION OF PERSONAL DATA

The RENTER's identity, contact, driver's license, reservation, rental, payment, vehicle usage, location, telematics and, where necessary, agreement/signature records may be processed in accordance with the applicable personal data protection legislation and the Data Protection (KVKK) Disclosure Notice separately provided by THELEON.

The Data Protection (KVKK) Disclosure Notice is separately provided to the RENTER.

In cases requiring data processing activities that require explicit consent, or commercial electronic message permissions, the relevant consents are obtained separately.

The signing of this agreement alone does not constitute the granting of explicit consent for advertising or marketing activities.

43. ELECTRONIC RECORDS AND VISUAL RECORDS

Tablet-signed agreement records between the parties, reservation records, delivery and return records, vehicle photographs and videos, emails, SMS, call center records, payment records and system date/time records may be used, to the extent legally permitted, in the resolution of disputes.

This provision does not eliminate the RENTER's legal right to present evidence and object to the records.

44. NOTIFICATION AND COMMUNICATION

The parties declare that the contact information specified in the agreement is accurate.

If the address, phone or email information changes, the change must be notified to the other party.

Mandatory legislative provisions regarding official notifications are reserved.

45. ANNEXES AND RECORDS OF THE AGREEMENT

The following records and documents may be considered as an annex and integral part of this agreement:

  • Vehicle Delivery and Return Form
  • Reservation / Rental Form
  • Additional Driver Records
  • Purchased Insurance and Coverage Packages
  • Damage Assessment Records
  • Delivery and Return Photo/Video Records
  • Data Protection (KVKK) Disclosure Notice
  • Other additional protocols separately accepted by the parties

46. STAMP DUTY

If stamp duty arises from this agreement, the related obligations shall be fulfilled in accordance with the applicable legislation.

47. NO WAIVER

THELEON's failure to exercise, or delay in exercising, any right arising from the agreement does not mean that it has waived that right.

Partial exercise of a right does not preclude the exercise of other rights.

48. PARTIAL INVALIDITY

If any provision of this agreement becomes invalid or unenforceable under the applicable legislation, this shall not automatically invalidate the other provisions of the agreement.

Mandatory legislative provisions are reserved.

49. RESOLUTION OF DISPUTES
